Effective Date: November 2, 2026
These Terms of Use ("Terms") are a legal agreement between you and Jones Environmental, Inc. ("Jones Environmental," "Jones," "we," "us," or "our") that governs your access to and use of jonesenv.com and any related pages, general inquiry forms, tools, calculators, downloads, and content that link to these Terms (the "Site"). These Terms govern Site use only and do not replace or amend any separate written service agreement, proposal, quote, chain-of-custody document, purchase order accepted by Jones, or other signed agreement governing laboratory or related services (each, a "Service Agreement"), which controls for the services it covers. Our Privacy Policy, available at jonesenv.com/privacy-policy/ (the "Privacy Policy"), and our Cookie Policy, available at jonesenv.com/cookie-policy/ (the "Cookie Policy"), are incorporated into these Terms by reference. If these Terms conflict with the Privacy Policy or the Cookie Policy regarding the handling of personal information or your privacy rights, the Privacy Policy controls; if these Terms conflict with the Privacy Policy or the Cookie Policy regarding any other matter relating to your use of the Site, these Terms control. Capitalized terms used but not defined in these Terms have the meanings given in the Privacy Policy or the Cookie Policy, as applicable.
By accessing or using the Site, you agree to these Terms and acknowledge our Privacy Policy. If you use the Site on behalf of an organization, you represent that you are authorized to bind that organization to these Terms. If you do not agree to these Terms, do not use the Site or any of its features.
PLEASE READ THESE TERMS CAREFULLY. SECTION 12 CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT HOW DISPUTES ARE RESOLVED. THEY REQUIRE THAT CLAIMS BE ARBITRATED ON AN INDIVIDUAL BASIS AND, TO THE EXTENT PERMITTED BY LAW, WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.
1. Eligibility
The Site is intended solely for business and professional use by individuals who are at least eighteen (18) years old and have the legal capacity to enter into a binding contract. Individuals under eighteen (18) may not use the Site or submit any information through it. You may not use the Site if you are barred from doing so under applicable law or if Jones has previously suspended or terminated your access. By using the Site, you represent and warrant that you meet these requirements and, if you use the Site on behalf of an organization, that you are authorized to bind that organization to these Terms. Jones may restrict, suspend, or terminate access, and may delete information submitted, if it reasonably believes these requirements are not met.
2. Services Are Governed by Separate Agreements
The Site provides general information about laboratory, mobile lab, and consulting services. It is not an offer to perform services. A Site visit, inquiry, form submission, file upload, quote or pickup request, calculator output, download, email, automated acknowledgment, chain-of-custody document, or delivery or attempted delivery of a sample does not create a contract or client relationship; constitute acceptance, custody, or preservation of a sample; authorize testing or reporting; establish price, method, detection limit, scope, pickup, turnaround, or priority; or impose any duty to act. Jones has no obligation to receive, secure, preserve, collect, transport, analyze, return, dispose of, report on, or otherwise handle a sample unless and until an authorized Jones representative confirms the engagement in writing and the parties complete Jones's required Service Agreement and chain-of-custody process. If these Terms conflict with an executed Service Agreement, the Service Agreement controls for the covered services.
Prices, availability, turnaround estimates, analyte lists, matrices, method references, detection or reporting limits, certifications, accreditations, locations, and capabilities shown on the Site are general information only. They may vary by sample, matrix, condition, method, laboratory, jurisdiction, capacity, quality-control requirements, and regulator, may change without notice, and are not binding unless expressly confirmed in an executed Service Agreement by an authorized Jones representative.
3. Information Only; No Professional Advice
All content on the Site, including articles, FAQs, guidance documents, regulatory summaries, screening levels, case studies, method descriptions, detection or reporting limits, and downloadable resources (collectively, "Informational Content"), is provided for general informational purposes only. Informational Content is not, and may not be relied on as, a site-specific sampling plan, quality-assurance plan, laboratory report, certification, or warranty, or as engineering, legal, regulatory, health, environmental, evidentiary, or other professional advice. Your access to or use of Informational Content does not create a professional, client, or other relationship between you and Jones.
Laws, regulations, permits, agency guidance, screening levels, methods, accreditation scopes, and acceptance criteria vary by jurisdiction and project and may change or be superseded at any time. Jones does not warrant that any Informational Content is accurate, current, complete, applicable, or sufficient for any regulator, permit, procurement, investigation, remediation, transaction, litigation, or other purpose, and Jones has no obligation to update it. You are solely responsible for (i) confirming current requirements with the applicable authority and qualified advisors; (ii) selecting an appropriate method and detection or reporting limit; (iii) designing an adequate sampling plan; (iv) establishing chain-of-custody and quality-control requirements; and (v) determining whether results will be representative, compliant, or admissible. Any reliance on Informational Content is at your sole risk.
NOTHING ON OR AVAILABLE THROUGH THE SITE, AND NO OUTPUT GENERATED BY ANY SITE TOOL, IS A LABORATORY REPORT, CERTIFIED RESULT, CERTIFICATION, REGULATORY DETERMINATION, OR PROFESSIONAL OPINION ON COMPLIANCE OR ADMISSIBILITY.
Only a final written report issued by an authorized Jones representative under an executed Service Agreement constitutes Jones's analytical results. Each such report is subject to its stated methods, qualifiers, detection and reporting limits, chain-of-custody information, quality-control data, assumptions, and limitations.
4. Calculator Tool and Other Interactive Features
The calculator tool and any other estimating or interactive features are planning conveniences only. Outputs depend on user inputs, assumptions, formulas, units, rounding, available data, and tool configuration and may be incomplete or erroneous. They do not evaluate sampling sufficiency, representative conditions, matrix effects, method suitability, preservation, hold times, quality-control requirements, detection or reporting limits, regulatory compliance, data usability, or legal admissibility. Tools are provided "as is" and are not a quote, Service Agreement, testing authorization, turnaround commitment, laboratory result, professional judgment, field measurement, site-specific work plan, or regulatory approval. You are solely responsible for validating all inputs and outputs with qualified personnel and applicable authorities before use.
5. Accreditations and Certifications
References to accreditations, certifications, licenses, or approvals, if any, are limited to the issuing body, laboratory location, field of testing, matrix, method, analyte, and effective period shown on the applicable current certificate or scope. Status and scope may change, and a listing does not establish suitability or regulatory acceptance for a particular project. Confirm current status and scope directly with Jones and the issuing body before reliance.
6. Intellectual Property
The Site and all content, tools, and materials on it, including text, graphics, logos, photographs, videos, documents, forms, software, and calculator tools, and the selection, arrangement, and compilation of all of it (collectively, "Site Content"), are owned by Jones or its licensors and are protected by U.S. and international copyright, trademark, trade secret, and other intellectual property laws. "Jones Environmental," the Jones logos, and related names, marks, and trade dress, whether registered or unregistered, are trademarks of Jones and may not be used without Jones's prior written permission. Third-party names and marks appearing on the Site belong to their respective owners. Except for the limited license below, no right, title, or interest in the Site or Site Content is granted to you, whether by implication, estoppel, or otherwise, and Jones reserves all rights not expressly granted.
Subject to your compliance with these Terms, Jones grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view the Site and to download and print forms and resources solely for your internal business use in connection with obtaining Jones Environmental's services, provided that you do not modify the materials and you retain all copyright, trademark, and other proprietary notices. Any other use, including reproduction, distribution, public display, creation of derivative works, or commercial exploitation of Site Content, requires Jones Environmental's prior written consent. This license terminates automatically if you breach these Terms, and upon termination you must destroy all downloaded or printed Site Content.
7. Acceptable Use
You will not, and will not assist, encourage, or permit any other person to:
- use the Site for any unlawful purpose or in violation of any applicable law, regulation, or third-party right;
- submit false, misleading, or fraudulent information, impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- upload, transmit, or introduce any virus, malware, ransomware, or other harmful or disruptive code;
- gain or attempt to gain unauthorized access to the Site or any related server, system, network, or account, or probe, scan, test, or circumvent any security or authentication measure;
- interfere with, disrupt, or impose an unreasonable load on the Site, including through denial-of-service attacks, spamming, or excessive requests;
- use any bot, scraper, crawler, or other automated means to access, copy, or extract Site Content or data, including to train, develop, or improve any artificial intelligence or machine learning model, without Jones' prior written consent;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Site, except to the extent applicable law expressly permits despite this restriction;
- frame or mirror the Site, or remove, alter, or obscure any copyright, trademark, or other proprietary notice;
- use the Site to send unsolicited commercial communications or any other communication prohibited by law; or
- use the Site, or any Site Content, tool, or output, in any manner that could damage, disable, or impair the Site or harm Jones, its users, or any third party.
Jones may, in its sole discretion and without notice or liability, suspend or terminate your access to the Site for any conduct that Jones reasonably believes violates these Terms or is harmful to Jones, its users, or any third party, in addition to any other remedies available at law or in equity, including referral to law enforcement.
8. Your Submissions
You are solely responsible for each submission you make through the Site and represent that it is accurate, lawful, non-infringing, and authorized by its owner and any applicable client, agency, employer, or other rights holder. General Site forms are not secure channels and may not be used for confidential, classified, controlled unclassified, export-controlled, law-enforcement-sensitive, government-sensitive, procurement-sensitive, proprietary, privileged, regulated, health, payment, credential, or other sensitive information; chain-of-custody records; sample identifiers or data; laboratory reports; or time-sensitive pickup, hold-time, preservation, testing, reporting, or emergency instructions (collectively, "Restricted Material"). Before transmitting Restricted Material, you must obtain Jones's written authorization to use a designated secure channel and follow any required handling procedures. Except as required by law or the Privacy Policy, Jones has no confidentiality obligation for, and no liability arising from, Restricted Material submitted in violation of this Section. Receipt of a submission, including any automated acknowledgment, does not mean Jones has accepted, reviewed, secured, or agreed to act on it. Personal information submitted through the Site is handled under the Privacy Policy; laboratory materials accepted by Jones are governed by the applicable Service Agreement and Jones's operational procedures. You grant Jones a non-exclusive, irrevocable, royalty-free license to use your submissions as needed to respond to you, operate the Site, and comply with law. Any ideas, feedback, or suggestions about the Site or Jones's services may be used by Jones for any purpose on a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable basis, without restriction, attribution, or compensation to you.
9. Third-Party Links and Content
The Site may contain links to, or embed content from, third-party websites, services, and providers, such as regulatory agencies, accreditation bodies, Vimeo, LinkedIn, and Google (collectively, "Third-Party Services"). Jones does not own, control, operate, monitor, or endorse any Third-Party Services and is not responsible for their availability, accuracy, legality, security, content, products, services, or privacy or data practices. The inclusion of a link or embedded content does not imply any endorsement, sponsorship, or affiliation by Jones. Any access to or use of Third-Party Services is entirely at your own risk and is subject solely to the terms and policies of the applicable third party. To the fullest extent permitted by law, Jones will not be liable for any loss or damage arising out of or related to your access to, use of, or reliance on any Third-Party Services.
10. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT, TOOLS, OUTPUTS, AND DOWNLOADS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS, AND JONES, ON BEHALF OF ITSELF AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS, DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT; ANY WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, CURRENCY, RELIABILITY, OR REPRESENTATIVENESS OF ANY CONTENT, TOOL, OR OUTPUT; ANY WARRANTIES REGARDING THE SUITABILITY OF ANY METHOD, DETECTION LIMIT, OR REPORTING LIMIT, OR REGARDING REGULATORY ACCEPTANCE, COMPLIANCE, OR ADMISSIBILITY; AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE AVAILABLE, UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SITE, ITS SERVERS, OR ANY DOWNLOAD IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM JONES OR THROUGH THE SITE CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS. YOUR USE OF AND RELIANCE ON THE SITE AND ANY CONTENT, TOOL, OUTPUT, OR DOWNLOAD IS AT YOUR SOLE RISK. ANY WARRANTIES FOR LABORATORY OR RELATED SERVICES ARE PROVIDED ONLY IN AN EXECUTED SERVICE AGREEMENT.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL JONES ENVIRONMENTAL OR ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS (THE "JONES PARTIES"), BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, BUSINESS, OPPORTUNITY, OR GOODWILL, OR ANY PROJECT DELAY, REGULATORY PENALTY, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THESE TERMS; YOUR ACCESS TO, USE OF, INABILITY TO USE, OR RELIANCE ON THE SITE OR ANY CONTENT, TOOL, OUTPUT, OR DOWNLOAD; YOUR SUBMISSIONS; ANY THIRD-PARTY SERVICES; OR ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL THEORY, AND EVEN IF A JONES PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
THE JONES PARTIES' TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). THIS SECTION DOES NOT APPLY TO LIABILITY FOR LABORATORY OR RELATED SERVICES PROVIDED UNDER AN EXECUTED SERVICE AGREEMENT, WHICH IS GOVERNED SOLELY BY THAT AGREEMENT. THE LIMITATIONS IN THIS SECTION ARE AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND JONES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN THOSE JURISDICTIONS, THE JONES PARTIES' LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
12. Dispute Resolution; Binding Arbitration; Class Action Waiver
Informal resolution first. Before filing any claim, you agree to contact us at legal@jonesenv.com and try in good faith to resolve the dispute informally for at least sixty (60) days.
Arbitration. Any dispute, claim, or controversy arising out of or relating to the Site or these Terms that is not resolved informally will be resolved by final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures then in effect, before a single arbitrator, in Los Angeles County, California, or by video conference. The Federal Arbitration Act governs this Section. Judgment on the award may be entered in any court of competent jurisdiction.
Class action waiver. YOU AND JONES ENVIRONMENTAL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any class or representative proceeding.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive or other equitable relief in court to protect its intellectual property, trade secrets, or proprietary confidential information. Disputes arising under a Service Agreement are resolved as that agreement provides.
Opt-out. You may opt out of this arbitration agreement by emailing legal@jonesenv.com within thirty (30) days after you first use the Site, stating your name and your intent to opt out.
Severability. If a court of competent jurisdiction determines, in a final decision not subject to further appeal, that the class action waiver in this Section is unenforceable as to any claim or request for relief, then that claim or request for relief, and only that claim or request for relief, will be severed from arbitration and must be brought exclusively in the state or federal courts located in Los Angeles County, California, as provided in Section 13. The court action will be stayed until any arbitration of the remaining individual claims is complete. In no event will any claim proceed in arbitration on a class, consolidated, or representative basis. If any other part of this Section is held unenforceable, that part will be severed and the remainder of this Section will remain in full force and effect.
13. Governing Law and Venue
These Terms, and any dispute arising out of or relating to the Site or these Terms, are governed by the laws of the State of California, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs Section 12. Subject to Section 12, any action or proceeding permitted to be brought in court must be brought exclusively in the state or federal courts located in Los Angeles County, California. You irrevocably consent to the personal jurisdiction of, and venue in, those courts and waive any objection based on inconvenient forum or improper venue. Disputes arising under a Service Agreement are governed by the law and forum provisions of that agreement.
14. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Jones Parties from and against all third-party claims, demands, actions, and proceedings, and all resulting liabilities, damages, losses, judgments, settlements, fines, penalties, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: (i) your access to or use or misuse of the Site; (ii) your submissions, including any Restricted Material; (iii) your misuse of Site Content, tools, or outputs; (iv) your breach of these Terms; or (v) your violation of any law or third-party right. If you use the Site on behalf of an organization, that organization is jointly bound by this Section. Jones may assume the exclusive defense and control of any matter subject to indemnification, at your expense, and you will cooperate as Jones reasonably requests. You may not settle any matter that imposes an obligation on, or admits fault by, any Jones Party without Jones Environmental's express prior written consent.
15. Copyright Complaints
If you believe that content on the Site infringes your copyright, send a written notice to Jones at legal@jonesenv.com or Jones Environmental, Inc., Attn: Copyright Agent, 10260 Matern Place, Santa Fe Springs, CA 90670. Your notice must include the information required by the Digital Millennium Copyright Act, 17 U.S.C. § 512(c)(3). Jones may remove or disable access to allegedly infringing content at its sole discretion and without liability and may terminate the access of repeat infringers in appropriate circumstances. Jones is not required to act on notices that do not substantially comply with 17 U.S.C. § 512(c)(3). Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that content is infringing may be liable for damages.
16. Changes to the Site and These Terms
Jones may modify, suspend, or discontinue all or any part of the Site, including any content, tool, or feature, at any time, with or without notice, and without liability to you. Jones may also revise these Terms from time to time by posting the revised Terms on the Site and updating the "Effective Date" above. Unless a later effective date is stated, revised Terms take effect when posted and apply only going forward; they do not apply to any dispute that arose, or any claim of which Jones had actual notice, before they took effect. Where a revision materially affects your rights, Jones will provide any additional notice, and request any affirmative consent, required by applicable law. Your continued access to or use of the Site after revised Terms take effect constitutes your acceptance of them. If you do not agree to the revised Terms, you must stop using the Site. You are responsible for reviewing these Terms periodically.
17. General
These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and Jones Environmental regarding the Site and supersede all prior or contemporaneous understandings regarding the Site, but they do not supersede any executed Service Agreement, which controls as provided in Section 2. If a court or other tribunal of competent jurisdiction holds any provision of these Terms invalid, illegal, void, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law and modified, limited, or severed only to the extent necessary, and the remaining provisions will remain in full force and effect. Such a determination in one jurisdiction will not affect the validity or enforceability of that provision in any other jurisdiction. No waiver is effective unless it is in writing and signed by an authorized Jones representative, and no failure or delay in enforcing any provision is a waiver. You may not assign or transfer these Terms without Jones's prior written consent, and any attempted assignment without that consent is void. Jones may assign these Terms without restriction or notice. The Jones Parties are intended third-party beneficiaries of Sections 10, 11, and 14. These Terms create no other third-party beneficiary rights. Sections 3, 4, 6 through 14, and 17, and any other provision that by its nature should survive, will survive any termination of these Terms or of your access to the Site. Headings are for convenience only and do not affect interpretation. The words "include" and "including" mean "including without limitation."
